Terms and Conditions for Using the Kernel Space
1. General Information
1.1. The Kernel space is owned and managed by St Andrews Environmental Network (StAndEN) and is located within St Andrews Botanic Garden.
1.2. The site operates off-grid, with solar panels and a diesel generator providing power. There is no running water at the facility.
1.3. By booking the Kernel space, the user agrees to comply with these terms and conditions.
2. Booking
2.1. Bookings must be made via the official booking system or through direct contact with StAndEN staff.
2.2. Users are responsible for ensuring their booking times include setup and cleanup.
2.3. Normal booking of the site is between 08:30 to 16:30 hours Monday to Friday. Any requirement to use the site during a weekend period, then special permission will needed, authorised through the St Andrews Botanical Garden. Due to security concerns the Viaduct gate will not be used during a weekend period.
3. Cancellation Policy
3.1. Cancellations must be made in writing (via email) as soon as possible to allow other groups to use the facility.
3.2. StAndEN reserves the right to cancel bookings due to unforeseen circumstances (e.g., adverse weather impacting site safety) or a conflict of interest.
4. Site Use
4.1. Users are required to respect the Kernel space, its off-grid infrastructure, and the surrounding Botanic Garden environment.
4.2. Activities must align with StAndEN’s mission to promote environmental sustainability. The site will not be used for illegal, unsafe, or environmentally harmful purposes.
4.3. Users cannot co-share the site unless other parties are in full agreement.
4.4. Noise levels must be kept to a minimum to respect other garden users and nearby residents. Amplified music is not permitted.
4.5. A maximum of 30 people can use the Kernel indoor areas at any one time, and a maximum of 14 cars parked.
4.6. The car parking area must be kept clear of rubbish, waste and materials at all times and is not permitted out with any areas designated. Any rubbish accumulated by users must be taken away at the end of each day and should not be placed in the rubbish bins used by the St Andrews Botanic Gardens
5. Health and Safety
5.1. Users must comply with all health and safety regulations, provided Risk Assessment, including any other guidelines provided by StAndEN regarding the off-grid infrastructure.
5.2. Any use of the diesel generator must be pre-approved by StAndEN staff, and only authorised personnel may refuel or operate it.
5.3. Users must ensure safe operation of all electrical equipment connected to the solar-powered system. Overloading the system is possible so consideration to levels of electrical load on the system must be applied to prevent loss of electrical power supply.
5.4. Open flames and smoking are strictly prohibited within the Kernel.
5.5. Users are responsible for conducting risk assessments for their activities and ensure it does not breach StAndEN Risk Assessments and Terms & Conditions. Users must provide a copy to StAndEN upon request.
6. Cleaning and Waste Management
6.1. Users are responsible for leaving the space clean and tidy after use. All waste must be removed from the site as there are no on-site disposal facilities.
6.2. StAndEN encourages users to minimise waste and avoid single-use plastics wherever possible.
6.3. Users may lose access to the site if is not left in a satisfactory condition.
6.4. Users must ensure urine capture vessels are emptied in the toilet building by the Boiler House. If Users end up with a build-up of solid waste, they are responsible for disposing of the waste at the same location. Anyone found dumping human waste will be reported to SEPA, may be prosecuted and will be banned from accessing the Kernel.
7. Liability
7.1. StAndEN accepts no liability for loss, damage, or injury to persons or property arising from the use of the Kernel space unless caused by negligence on the part of StAndEN.
7.2. Users are responsible for ensuring they have adequate insurance coverage for their activities, including public liability insurance where required.
7.3. Any damage to the Kernel space or its infrastructure must be reported immediately, and the user may be held liable for repair or replacement costs.
8. Accessibility
8.1. The Kernel space is located within the Botanic Garden, and access may involve uneven paths or natural terrain. Users with specific accessibility needs are encouraged to discuss these with StAndEN staff prior to use.
8.2. Users are responsible for ensuring the safety and accessibility of their event for all attendees.
9. Termination of Use
9.1. StAndEN reserves the right to terminate a booking or ask users to vacate the premises if there is a breach of these terms and conditions.
10. Feedback, Complaints and Decision making
10.1. Feedback about the space or booking process is welcomed and can be submitted via email to StAndEN staff.
10.2. Complaints will be handled in accordance with StAndEN’s complaints procedure, which is available upon request.
10.3. The Director of The Botanical Garden has authorised StAndEN to manage every element of The Kernel site. Therefore, StAndEN has the final say in a case of a dispute. The site is not to be modified unless approved and must be constantly kept clear of waste and clutter.
11. Amendments
11.1. StAndEN reserves the right to amend these terms and conditions at any time. The latest version will be made available on the StAndEN website or provided upon request.
